How Is an Uncontested Divorce Settlement Agreement Prepared, and What Should It Contain?

The key document in an uncontested divorce is the settlement agreement; how concrete the text on which the court bases its decision is directly affects whether the process proceeds smoothly. In this article, instead of repeating the general conditions, we focus directly on the content of the agreement: how the custody clause should be structured, how the amount and method of payment of alimony should be written, with what details the division of property, dowry (jewellery) items and compensation clauses should be arranged, and how the return of personal belongings and the visitation schedule with the child should be made concrete. We also address, with examples, why vague expressions that most often lead to disputes in practice — such as "visitation at reasonable times" — carry risk, and which concrete expressions should be preferred in their place.

This article addresses, with concrete examples, both which types of data are less contentious and which situations carry serious legal risk. Which Mistakes in a Contested Divorce Cause Loss of Rights?

In contested divorce cases, how the file is conducted determines the outcome just as much as the merits of the file. Mistakes such as missing the evidence period, notifying the witness list incompletely, not using the right to amend, harming oneself with social media posts, going to a hearing unprepared and missing the appeal period can lead to losses that are difficult to make up for, even if the party is essentially in the right. In practice, most of these mistakes are largely preventable when the file is prepared carefully at an early stage and the process is followed together with a lawyer. In this article, the most frequently encountered mistakes of this kind are addressed together with concrete examples, the consequences they produce and the practical ways to protect against them. The aim is not to recount the general workings of the divorce process again; it is to highlight the critical moments that weaken the file and to enable the reader to see whether they face a similar risk in their own file.
